Keep the Cold Springs Valley Rural

We live in the Cold Springs valley and chose this area, among other things, to avoid the fiscal irresponsibility of the city. We also like larger lots, minimal traffic, minimal industry, lower taxes, inexpensive water, better roads, and better and more friendly law enforcement. The annexation is an affront to all we love about this area. It is also simply for the financial gain of a developer and the city and not for the best interests of the people, the city, or the county.

These facts being evident, we have created the group "Citizens for Cold Springs". As a group, we have filed a legal complaint in district court with the intent to reverse the annexation caused by the City Council's recent action. That suit has continued on and is now at the Nevada Supreme Court.

The current situation is that the city rezoned the land, in spite of the fact that there is no water in the valley with which to build. The city does not require any services be available or planned prior to rezoning, although state law does. The Citizens for Cold Springs filed suit in district court against this rezoning (unrelated to the suit over the annexation). On Aug 29, 2007, Judge Robert Perry found in favor of the Citizens. Judge Perry found that the city "appears to have ignored" state law, and that "Rather than being in 'substantial compliance' with [state law and Reno city ordinance], there was no compliance." The Court found that this "was done in disregard of the procedures set out in [city and state law] and constitutes an arbitrary and capricious abuse of discretion." With these findings, the Court ordered that the rezoning be nullified and that no development may be approved. We are certainly very pleased with this decision.
